    I have a dispute with the CRA regarding a principal residence exemption for the condo that I disposed in 2010. I filed an objection and it was rejected and a couple of weeks ago I received a letter which stated that I need to file a Notice of Appeal to the tax court. i was wondering whether you’d be able to help me with this.   4. I’m trying to help family members find someone to help.

    They have a lien against their house and a letter has been sent to the mortgage lenders so that they won’t get renewal of their two mortgages, which are both due this November.

    The CRA tax owing is substantial and in only one of the homeowner’s names, and they want to sell, but the CRA worker is telling them that the lien will not be removed until the sale, but the real estate agent is apparently telling them it won’t sell unless the lien is removed.

    I saw a blog post that said some arrangement could be made to have it lifted with a promise to pay CRA from the proceeds of the sale. It sounds like it will not be anywhere close to paying off the tax debt though, especially after the bank is paid back.

    The family members live in Toronto, so I wanted to see if this is the type of thing you could advise on and help with, or if there is some different professional whose advice we should seek (lawyers want a lot of money just to meet so they would rather know if that’s the right route first).

    For my part, I’m wondering if an arrangement can be made for the entire equity of the debtor portion can be promised to CRA and what happens after that if the debt is still crippling? The amount may still be over $250K, so potentially not eligible for a proposal(?)

    One final point is that he filed for forgiveness of the interest (which is by far the largest part of the debt, I’m under the impression the actual tax owing is relatively small) about a year ago. The CRA worker told him they won’t even consider the application until he starts making payments as a show of good faith. He can barely make any ends meet as it is, never mind make CRA payments, so this just seems so strange on the part of CRA.

    Anyway, thanks for any advice you can give me. I’ve read through some of your blog and find it really helpful, but I think it would’ve been a better find previous to things getting this bad.

    Looking for some advice in dealing with CRA . I filed a CP on July 28 2014 , CRA is the major debtor. They have been dragging their heals , set up a CM , but did not show up. They have now set one up for Monday Nov 10 in which they will render their final decision. John Collins(Toronto office) was assigned to my file , he recommended that it be not approved , however his boss Penny ? reviewed it and has asked for the meeting.

I have just received a certificate of registration letter from the CRA stating that they have registered a Certificate in the Federal court for the amount of money I owe to CRA, which must be sent immediately. In the past year I have had dealings with agents from the CRA trying to set up payments in so much as sending all financial statements to an agent, who was taken off my case and to another agent in Kingston who went on leave in June and told me that another agent would be intouch with me in the Fall. I waited to here from an agent which wasn’t the case instead I get this letter. Can you advise where to go next?

  8. Best friend going for through a divorce. She was married less than 3 years. She was aware / was told by her fiancé he had a small tax problem when he asked her to marry her. She refused to marry him until he filed all his returns and sorted it out. He filled out the tax forms saying they were filed and he was good with CRA.

    My friend is a smart business woman and must have really been blinded by love to miss the early sign – let me lay out the situation.

    This guy works as a realtor. He has been evading CRA since 1996. It appears he moves in and out of marriages with women who have financial means – so he can use their business assets to hide his.

    They married in 2008. She thought she was wife number 2. She is wife number 5. He uses at least 3 different variations of his legal name and a number company to receive commission and other forms of renumeration. When cra catches up with him, and starts garnishments – the broker or employer cuts him loose. He always had a clever explanation for his wife as to why he leaves a job.

    The situation became obvious when cra seized a joint account of my friend. She put her husbands name on it for convenience and 18 months later cra latched onto it. My friend had 120,000 in that account. She filed for divorce and moved into a rental.

    He is trying to put her on the hook for his tax debt. After she had him removed from her house, he accused her of not letting him have his stuff. He had squatted in her house for over 6 months not paying anything. He could have taken what he wanted. So I’m cataloging it all and I can’t believe what I’m finding in his papers. He has had issues misfiring since 1989. There are documents showing penalties and arrears going back to 1996. He has used at least 3 aliases with employers to hide his income. Used one numbered company and 2 gst numbers and overs taxes on all of them. His numbered company has yet to file taxes

    The worst part is that he has attached his aliases to properties owned by my friend and even a property owned by her company. He then engages local utility companies so he can get services like cell phone and realty services under this new variation of himself. Once cra catches on, he starts all over with a new variation / identity and starts again. He owes over$200,000 in personal income tax and GST. Plus lord knows how much on the numbered company he’s never filed. Worst of all – he’s used some of my friends assets to hide. Now he put liens on those properties claiming interest and is telling her he wants half and that she now owns half his tax debt

    I really don’t know how to advise my friend or where she should turn to for help. Her $350 an hour lawyer doesn’t seem to be up for the task.

    Please let me know what I can do to save my friend from this predator. I Think it’s criminal what he is doing.

  10. Good afternoon! I emailed a case to you in Novmber, and subsequently was emailed back by Mr. Warren Orlans. I emailed further pertinent information at the end of November to better understand the major players. He said he would speak to CRA and they backed off and don’t send me letters. I was worried so I asked him and he said we’re doing fine. We have emailed twice in the past two weeks. We are making progress. I just wanted to say publically thank you. What a relief.

  11. UGENT My husband hasn’t filed his personal taxes or business taxes for over 7 years. Before that he never dealt with finishing the previous 7 and an estimation of over 160,000 was made. He usually claimed me as a dependent, and now it’s estimated I owe over 7,000 when I haven’t worked and when I did help him I worked rarely. They have threatened with a lien on the house. What do we do? Also he never kept any receipts or did much book keeping the last 7 years, what with losing much of his info with his computer crashing. Can you help? Also are these estimations fixed or can they be re-assessed? Thanks so much,

    I have a buyer for the appraised value, but their lawyer is afraid of the CRA and won’t proceed without CRA permission.

  13. Hello there: Laurie from Woodstock here, I am going back to school on the Second Career program. This year, I filed my taxes through Turbo-tax and I am wondering if I claimed all of the credits I qualify for as a post secondary student. Especially since 2012, my sole income is spousal support and I was unaware of the taxation of that income. In 2014 I was nailed with a $5800.00 tax bill for the support amounts I received. Any deductions I can claim would be very helpful in reducing this tax bill. For instance, are fuel costs for school allowable? I drive from Woodstock to Kitchener 5 days a week a distance of approximately 70km each way. Please advice, Laurie. Thank you for your time.

Afternoon, I was audited 5+years ago, never had “my day in court” to dispute any of the cra claims, over the last five years have had my bank accounts frozen 3 or 4 times – each time after complying with their requests for more details before releasing, has been costing me more each time to get ‘back on-track and to work’. But now, just after this last time, a month ago, which to my understanding there was an agreed upon payment plan in place – even though I still do not agree with their assessment – this past week was informed liens have been registered against my property with no chance to have them removed, even for refinancing ( which is what the cra lady and I have been discussing these past few months, in good faith ) which would result in the cra getting more of their money sooner. against advise, I did not seek legal council for my audit, was upfront and forecoming with everything. last year I approached dioguardi but the 10 to $15,000 cost, to start, was and is over my available funds. you mention a retainer would be required, at $250-$350/hour, and for my case, now representative of a ‘well shuffled deck’, would my dollars be better invested in a good accountant and just start paying the govt what they ask for ? and hope I don’t get more audits after im done paying, or afford your assistance in my ongoing tax troubles, assuming that after your company ‘audits my taxes’ the outcome will be atleast done fairly with an outcome that I can trust to be accurate and with a payment plan the govt honors,so my family and I can get back to living without the worry of the next phone call being the bank informing us of yet another cra seizure or worse. I know its not much detail, but hopefully you can read this with some understanding of the situation I have gotten myself into over the past 5 years of audits, objections, late filing and generally not dealing with my tax problem properly or with trustworthy people, and with still a few of those 15 minutes left to provide an inspirational, respectful and honest reply. I found your site goggling the ‘tax relief option’ I was told about my my broker. you are correct, knowledge is power, and I am finally agreeing that I do not have the time to learn and understand everything I thought I could over these past years…life happens.     i have been contacted by CRA today because in 2002 2003 2004 i got my income tax done at Executive Accounting near Toronto and now they want $12,000.00 and that is with interest, because i thought i was giving money to a church which wasn’t the case.The woman who owned this business has been charged and she is now in jail. I am not sure if there is anything i can do about my situation.. Your help would be greatly appreciated .

    I need legal advice on how to proceed with the voluntary disclosure of 13 years of undeclared European earnings 2003-2015. I was (and still am) an international translator working with European clients. I am 82 yrs old (Can.citizen) and have been drawing a small Canadian pension of 20-24K year since 1999 am and forced to continue working. In Europe, my wife starting suffering from brain anomalies and we returned to Canada for treatment. Subsequently she suffered a minor but potentially fatal deep brain hemorrhage and 2 repeats that leave her partially incapacitated. My wife is 36 years younger than me and incapable of earning a living. She has never been employed. She used to be a classical music student in Kiev and Tel Aviv. My panicked decision to keep me from declaring was prompted by my fear of leaving her without enough survival funds after my death. The undeclared earnings are probably
    some 700K+ but I have no longer any official supporting documents for my earnings and 13 yrs is a long way back to remember for an ageing man. I realize that this is a very difficult situation but want at least to make it known to Rev.Can. that I wish to act before health issues become too overpowering and my wife is left on her own to cope. Perhaps there are compassionate grounds that can be invoked. I certainly never acted with criminal intent.
    PS: I should mention I suffer from throat problems and communicate best via email. I dont know if that too is a problem. Tel. converse is difficult albeit not impossible with enough patience. Perhaps you will favour me with a reply.

  23. Hi George,

    I firmly believe that any offer of settlement proposed by the CRA – where they will agree to accept the donation amount as an actual donation – is preferable to having them deny it altogether and then try to collect on the balance.

    Objections are an important tool to be used, provided the objection was not written by the promoter of the tax shelter – and if additional information is provided which contradicts the CRA’s views.

    Ultimately, there will be monies owing to the CRA. Best to make that as little as possible.

    I also strongly recommend a Taxpayer Relief application as it could reduce some or all of the penalties and / or interest assessed on the tax account of yourself and your wife. If you need assistance with that, please send us an email to info@intaxicating.ca

    Please advise if you know anything about the GLGI company who provides charitable donation schemes to the clients since 2002/2003 until 2012 ?

    Recently CRA won a case(Mariano v. The Queen 2015 TCC 244) against them in the Tax court of Canada.

    Now CRA sending letters(Notice of Confirmation) to all the donors for paying the amount of owing in 90 days.

    Some tax/law companies like Tax Solutions Canada and Merchant Law group are suggesting either go with the Interest Relief option with re-appeal on the tax court OR involve in the Class action against CRA which will take few years to make a decision but the problem is the Interest will keep growing on 5% compounding rate.

    So what is your/your company advise on that?
    Also what is your retainer fees if I take your service for either Re-Appeal or Apply for Tax Payer Interest Relief?

  29. hi warren this is robbie p we corresponded before christmas i sent you the info that i sent to rca you were going to crrespond with cra. i was wondering if there was any correspondance back i received 2 letters from cra that were forwarded to companies i previously worked for they were to take away garnishies for 28000 and 65000. how did you get them to stop pursueing this or what did you say.please let me know what i need to do now if anything. amazing.

    My wife and I donated to universal health trust (UHT) in 2008, 2009, and 2010.
    We filed a Notice of Objection to the CRA after our deductions were denied.
    The CRA have made an offer to settle, but I don’t know if that is in my best interest.
    Based on your significant experience with Tax Shelters – what would you recommend?
    I would greatly appreciate a consultation as my deadline to get back to the CRA regarding their settlement is this week.

    I WAS WORKING IN CANADA FROM FEBRUARY 9, 2008 TO OCTOBER 11, 2008 ON WORK PERMIT.
    LATER I WAS WORKING FROM OCTOBER 1,2009 TO MAY 30, 2010.
    I FILED MY 2008 TAX RETURN AS RESIDENT. I RECEIVED A NOTICE FROM CRA RECENTLY WITH ARBITRARY ASSESSMENTS FOR YEARS 2008, 2009 AND 2010 TREATING ME AS
    NON-RESIDENT.

    After I left Canada in 2010, I have come back in 2016 as a PR.
    I took help from a tax consultant to get my tax, penalties and interest waived-off and had filed a letter of objection to CRA. However, CRA rejected my request citing the reason that the request is well beyond the last date of objection.

    I have lost hopes and sitting on roughly $ 7000 of due including interest and penalties.
    Is there still a hope or I have to pay off all of it?

  34. When the CRA puts a lien on a property, we are advised to contact a lawyer. Why is that?
    Can we not get written confirmation from the CRA ourselves that after the lien amount is paid, the lien will be removed within a set period of time?
    If they agree to do it, do they just delay anyway or check whether they want anything else from you first?

  35. Hi T,

    Not sure if you got my previous response – but when the CRA registers a lien against a property, it’s usually not a concern unless the property is going to be sold, or if it needs to be re-financed. In that case, the lien needs to be addressed. Otherwise, the amount the CRA registers the lien for is the amount owing on the day the lien was registered and interest and possibly debt continues to accrue on the account.

    The CRA cannot and will not provide confirmation that once a lien is paid that the lien will be removed because there might be additional debts which the CRA is going to need to register a lien for. They prefer not to put things in writing which could come back to cause them problems collecting tax debts.

    If however, there is a just a tax debt, and the collector registers a lien and the lien is paid, and that means the balance is paid in full, the problem for the collector is that the account disappears from their inventory of accounts so they lose the ability to see that it was paid in full and then they can remove the lien. They need to be reminded there is a lien in place so they can finish it up, remove the lien and close the account. Otherwise, it can be very difficult to get a lien removed after the fact because there is no one assigned to it, and no one wants to take responsibility for working an account which is not assigned to them.
